A Minnesota bill (SF1215) proposing a ban on certain flame retardants in children’s product or upholstered residential furniture has been signed by the governor of Minnesota on 19 May, 2015.

According to the final version of this bill, from 1 July, 2018, no manufacturer or wholesaler may manufacture, sell, offer for sale, distribute for sale, or distribute for use in this state a children’s product or upholstered residential furniture containing, in amounts greater than 1000ppm in any product component, the following flame retardants:

From 1 July 2019, the requirements will be extended to retailers.

In the original bill, ten flame retardants were proposed to be banned that etrabromobisphenol A, tetrabromo phthalate (TBPH), tetrabromo benzoate (TBB), chlorinated paraffins, tris(1-chloro-2-propyl)phosphate (TCPP) and antimony were also put forward, and the limit is 100ppm. Note:

• Children’s product: a product primarily designed or intended by a manufacturer to be used by or for a child under 12 years of age, including any article used as a component of such a product, but excluding a food, beverage, dietary supplement, pharmaceutical product or biologic, children’s toys that are subject to the most recent version of ASTM F963, or a medical device as defined in the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. 321(h) and some other certain products.
• Upholstered residential furniture: furniture with padding, coverings, and cushions intended and sold for use in the home or places of lodging.
• Residential textile: a textile designed for use in the home or places of lodging as a covering on windows, walls, or floors, including carpeting and carpet padding
