The National Institute of Metrology, Quality and Technology (INMETRO) has published Ordinance INMETRO No. 302/2021 “Quality Technical Regulations and Conformity Assessment Requirements for Toys”. It entered into force on 2nd August 2021. The major requirements are highlighted below:

1.Revocation
It revokes those ordinances in the following dates:

• Ordinance INMETRO No. 8/1997: immediately
• Ordinance INMETRO No. 108/2005: 1st July, 2025
• Ordinance INMETRO No. 369/2007: 1st July, 2025
• Ordinance INMETRO No. 321/2009: 1st July, 2025
• Ordinance INMETRO No. 152/2010: 1st July, 2025
• Ordinance INMETRO No. 377/2010: 1st July, 2025
• Ordinance INMETRO No. 117/2011: 1st July, 2025
• Ordinance INMETRO No. 563/2016: 1st January, 2022
• Ordinance INMETRO No. 217/2020: immediately

The validity of the related INMETRO Ordinances are restored as of the publication of this Ordinance, whose validity will remain in force until 1st July, 2025, when they will be revoked: Ordinance INMETRO No.133/2003, Ordinance INMETRO No. 49/2008, Ordinance INMETRO No. 459/2014 and Ordinance INMETRO No. 99/2016

2.The ordinance contains several important provisions as below:

• Establishes the consolidated regulation for toys in the form of quality technical regulations (Annex I), conformity assessment requirements (Annex II) and specifications for the conformity identification seal (Annex III) – suppliers may choose Certification Model 1b, 2 or 5 for conformity assessment requirements
• Requires certified toys to be registered with INMETRO
• States that toys falling within the scope of the Ordinance are subject to market surveillance activities by INMETRO and other public enforcement agencies
• Requires suppliers to furnish the required information within 15 days when requested by INMETRO
• Provides a (non-exhaustive) list of products that are considered as falling under the scope of toys (Annex IV) and a list of products that are not considered as toys (Annex V)
