Summary of Law Updates:

Labour

1. < Administrative Measures on Wage Payment by Enterprises in Zhejiang Province > (2017-05-01)

The amended < Administrative Measures on Wage Payment by Enterprises in Zhejiang Province > (hereinafter referred to as Measures) was gazetted by the People’s Government of Zhejiang Province on 2nd March 2017, it has come into force on 1st May 2017. Compared with the previous version of the Measures, the improvements and amendments are mainly as follows,

A. Wage components and payment cycle of part-time employment are defined.

• Wage components and the definition of wages under special conditions are defined by the Measures. Meanwhile, the wage payment cycle of part-time employment is explicitly provided to be no more than 15 days.

B. Provisions on delayed payment due to difficulties in business and production.

• Provided by the Measures, when an enterprise is truly experiencing difficulties in business and production, after collective negotiation or agreed by the employees per se according to law, full or part of wage payment could be deferred but the delay shall be no more than 30 days. Compared with the previous version of the Measures, the maximum delay is changed from 15-day to 30-day.

C. Responsibilities of enterprises to retain and provide payroll records and attendance records.

• Requirements are added in the Measures. The payroll records shall be retained for no fewer than 2 years. The attendance record system shall be established and the attendance records shall be retained by the enterprise for no fewer than 2 years. The employees are entitled to make enquiry and to verify their own payroll and attendance records.

Health and Safety

1. < Code for Design of Dormitory Building JGJ 36-2016 > (2017-06-01)

The Code for Design of Dormitory Building JGJ 36-2016 (hereinafter referred to as Code) was deliberated and adopted by the Ministry of Housing and Urban-Rural Development of the People’s Republic of China on 15th December 2016 and it has come into force on 1st June 2017. The previous Code for Design of Dormitory Building JGJ 36-2005 was abolished simultaneously. The main changes of the Code are as follows.

1. The requirements of base and outdoor environment are refined, and the safety indicators are added.
2. Configuration standards of facilities in auxiliary rooms are adjusted.
3. Section of fire prevention and safety evacuation is newly added, and the requirements of indoor air quality are added in the section of indoor environment.
4. The number of Terminologies increases from 9 to 11 including the definitions of public toilet and public kitchen; the terminology of washroom is modified to public washroom, and public washroom is redefined.
5. The number of categories of habitable room is adjusted from four to five. Meanwhile, usable area per capita of Categories 3, 4 and 5 is increased by 1 square meter each.

Environmental

1. < Catalogue for Classified Administration of Environmental Impact Assessments for Construction Projects > (2017-09-01)

The new revision of Catalogue for Classified Administration of Environmental Impact Assessments for Construction Projects (hereinafter referred to as Catalogue) has been issued by the Ministry of Environmental Protection of the People’s Republic of China on 29th June 2017, and it will come into force on 1st September 2017. Major amendments and improvements are as follows:

1. Adjustment is made to the priority and classification of project category for practicality, simplicity and operability, and by reference to National Economic Industrial Classification Code and the needs of classified administration of environmental impact assessments for construction projects. The revised Catalogue consists of 50 categories and 192 subcategories.
2. Farmland renovation project, agricultural transgenic project, species introducing project, elementary geological exploration, geological exploration for water conservancy and hyｄｒｏｐower engineering, forest harvesting engineering, prevention and control of desertification engineering, film shooting and large-scale live show, and activities of general community service are excluded from the new revision of the Catalogue.
3. Project categories that generally consistent with the former version of Catalogue are: petrochemical industry, coal, ferrous metals, nonferrous metals, medicine, light industry, water transportation and social programs and services.
4. Project categories of lowering in grading of environmental impact assessment are: mechatronics, highway, railway, mining, selecting and manufacturing of non-metallic minerals, and urban transportation facilities.
5. Project categories of escalation in grading of environmental impact assessment are: mining, selecting, smelting and recycling of waste residue for associated radioactive mineral resources, handicraft manufacturing and products manufacturing by bamboo, rattan, palm, and straw.

2. < PRC Law on Prevention and Control of Water Pollution > (2018-01-01)

The PRC Law on Prevention and Control of Water Pollution was amended and adopted by the Standing Committee of the National People’s Congress on 27th June 2017, and it will come into force on 1st January 2018. Highlights of the amendment are as follows:

1. To implement the total quantity control system and the pollution discharge permit system.
2. The obligations on self-monitoring by pollutant discharging entities are explicitly defined.
3. It is explicitly defined that the enterprises and institutions shall take anti-leakage measures and strengthen the monitoring on groundwater quality.
4. The requirements on declaration and registration of the discharged pollutants, acceptance check of prevention and control of water pollution, approval for the prevention and control facilities of water pollution which are left idle or dismantled, and pollutant discharge fees are removed.
