USA Washington CSPA - Cadmium, Phthalates and Lead requirements

Washington Department of Ecology provided guidance to clarify the ambiguity around the Part 1 of the Children’s Safe Products Act that has restrictions for cadmium, lead and phthalates for certain children’s products. This guidance is provided by the Department for clarity to the regulated industry on the Washington CSPA requirements, as well as preemption by Federal law, where it exists.

The department will evaluate if the product is a children’s product (as defined by Washington CSPA), followed by determination if the product will be covered by the Federal requirement (CPSIA).  If product is considered as a children’s product and not covered by the CPSIA requirement, the Washington CSPA part 1 restrictions will apply.

Summary of Washington CPSA requirements:

  • Total lead content ≤ 90 ppm (apply to children’s cosmetics and children’s car seat which are not covered by CPSIA definition of children’s product) 
  • Total cadmium ≤ 40 ppm (apply to all children’s product (as defined in WA-CSPA) except toys)
  • Phthalates (DEHP, DBP, BBP, DINP, DIDP and DnOP) ≤ 1000 ppm (apply to all children’s product (as defined in WA-CSPA) except toys and childcare articles)
