Italy Requires Certain Single-Use Packaging to be Industrially Compostable

On 7 August 2026, Italy published Decree-Law 7 August 2026, No. 143 (DECRETO-LEGGE 7 agosto 2026, n. 143) to amend Legislative Decree No. 152 of 3 April 2006 (DECRETO LEGISLATIVO 3 aprile 2006, n.152), requiring the following four types of single-use packaging to be certified with UNI EN 13432 on industrial compostable packaging standard (or equivalent compostability recognized at the European level) by accredited bodies:

  1. Single-use plastic packaging for less than 1.5 kg of pre-packaged fresh fruit and vegetables;
  2. Single-use plastic packaging for food and beverages, filled and consumed within the premises in hotels, restaurants, and catering;
  3. Single-use plastic packaging in hotels, restaurants, and catering, containing individual portions or servings, used for condiments, preserves, sauces, coffee creamer, sugar and seasoning, except in the following cases:
    1. Such packaging is provided together with take-away ready-prepared food intended for immediate consumption without the need of any further preparation.
    2. Such packaging is required to ensure safety and hygiene in establishments where there is a medical requirement for individualised care, such as hospitals, clinics or nursing homes.
  4. Flexible single-use packaging for cosmetics and hygiene products for use in the accommodation sector, as described in ATECO 2025 - Classification of economic activities, intended for an individual booking only and intended to be discarded before the next guest arrives.

The decree-law entered into force on 8 August 2026 and will apply from 1 January 2030.

Please note that the four types of packaging will still be banned in other EU Member States from 1 January 2030 according to the EU PPWR Regulation (EU) 2025/40 Article 25(1) and Annex V, even when certified with UNI EN 13432.
