Overview of the Mandatory Standard

On December 15, 2025, the U.S. Consumer Product Safety Commission (CPSC) established a mandatory safety standard, 16 CFR Part 1250.5, specifically for infant neck floats to reduce the risk of drowning while children use these products. This standard falls under the framework of the U.S. Toy Safety Standard, 16 CFR Part 1250. Products must simultaneously comply with the requirements of both 16 CFR 1250.1 and 16 CFR 1250.2.

Scope of Regulated Products

This regulation applies to infant neck floats, which are specifically defined as: devices designed to be worn around the neck that support a child’s weight via the neck ring structure, whether inflatable or inherently buoyant (non-inflatable), intended for water play in sinks, baths, paddling pools, swimming pools, and is intended for use by children up to and including 4 years of age in water environments.

This standard includes inflatable, inherently buoyant (non-inflatable), and combination-type (combination of both inflatable and inherently buoyant components) neck floats. Professional life-saving equipment certified by the U.S. Coast Guard is excluded from the scope of this regulation.

Effective Date and Implementation Timeline

  • Original Effective Date: June 15, 2026
  • Latest Extension Announcement: On May 19, 2026, the CPSC issued a new announcement stating that due to an insufficient number of CPSC-accepted third-party conformity assessment bodies, testing and certification for neck floats could not be completed prior to the June 15, 2026 effective date. Consequently, the deadline for third-party testing and certification has been extended by 60 days:
    • This extension applies only to the certification by third-party conformity assessment bodies.
    • Starting June 15, 2026, all neck floats entering the U.S. market must physically and fully comply with all safety provisions of 16 CFR Part 1250.5. Non-compliant products are strictly prohibited from sale.
    • After August 16, 2026, all neck floats offered for sale must be tested by a CPSC-accepted third-party conformity assessment body to evaluate compliance with CPSC regulations.
    • Eligibility for Extension: Manufacturers (including importers) shall submit samples of the finished products intended for sale in the United States to the CPSC to be eligible for this extension.

Intertek has been officially recognized by the CPSC. Manufacturers (including importers) may complete all relevant tests directly at Intertek. No application for this extension is required, enabling full compliance to be achieved expeditiously.

Core Regulatory Testing and Compliance Requirements

16 CFR Part 1250.5 primarily specifies tests targeting risks such as drowning, structural failure, and detached components in neck floats. The core requirements are summarized below:

  • Environmental Pre-conditioning Tests
    Before official testing, all products must sequentially undergo temperature cycling tests, chlorinated saltwater immersion tests, and ultraviolet (UV) aging tests.
  • Minimum Buoyancy Test
    The upward buoyancy of the product must not be less than 30% of its rated weight capacity. For inherently buoyant (non-inflatable) products like foam, the buoyancy loss after 24 hours of immersion must not exceed 5%.
  • Restraint System Test
    Fastening structures such as buckles and straps must feature a dual-action release mechanism, or a single-action release mechanism requiring a force of no less than 50N, to prevent accidental detachment during use. They must also pass attachment strength tests to prevent components from falling off.
  • Neck Opening Test
    Dynamic swing tests must be conducted using standard probes corresponding to the designated age groups. The head probe must not pass through the neck opening, ensuring that a child’s head cannot slip through, which poses a drowning hazard.
  • Labeling and Warning Requirements
    The product, outer packaging, and instruction manuals must use specified standard warning language and comply with relevant requirements regarding format, color, and size.
