Gentle Reminder from Intertek: The mandatory enforcement date for the eFiling rule is approaching soon.

• Jan 8, 2025: CPSC issued Final Rule 16 CFR Part 1110.
• July 8, 2026: Rule effective for most CPSC-regulated products/substances (excluding those imported into a Foreign Trade Zone (FTZ) and subsequently entered for consumption or warehousing).
• Jan 8, 2027: Rule effective for CPSC-regulated products/substances entered from an FTZ for consumption or warehousing

In Jan. 2026, the U.S. Consumer Product Safety Commission (CPSC) released the Guidance and HTS List for the Electronic Filing (eFiling) of Certificates of Compliance. 

It is a list of approximately 600 Harmonized Tariff Schedule (HTS) codes that CPSC believes are likely to include a product subject to a mandatory standard or are otherwise deemed high-risk. However, it is important to note that the list does not encompass all HTS codes where an electronic certificate may be required. These codes will be flagged in the Automated Commercial Environment (ACE) once eFiling becomes mandatory on July 8, 2026. The importer is responsible for eFiling a certificate whenever required.

The trade community is also encouraged to review CPSC’s 1USG Messaging guidance, as any entry with an eFiled certificate (a CPSC PGA Message Set) will be subject to the 1USG Messaging process. In addition to the products likely subject to certification and eFiling, there are other products that do not need certification but will still go through the 1USG messaging process. Please see the messaging guidance document for details on those product categories.
