In September 2024, U.S. congress proposed bill H.R. 9864, “Keep Food Containers Safe from PFAS Act of 2024” to prohibit food packaging containing intentionally added PFAS.
Per the proposal, the Section 301 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 331) will be amended by adding a clause which would prohibit the introduction or delivery for introduction into interstate commerce of food packaging containing intentionally added PFAS from January 1, 2025.
In the proposal, “PFAS’ means a perfluoroalkyl substance or a polyfluoroalkyl substance that is man-made with at least 1 fully fluorinated carbon atom.
