On September 29, 2024, the Governor of U.S. California State signed Bill AB 347 to enforce PFAS prohibitions in certain products. 

Currently, California has approved following three bills to regulate PFAS in specific consumer products: 

  • AB 652 for juvenile products 
  • AB 1200 for plant-based food packaging
  • AB 1817 for textile articles 

California now approved Bill AB 347 to introduce enforcement mechanisms for existing and future perfluoroalkyl and polyfluoroalkyl substance (PFAS) bans and labeling requirements; and also to name the Department of Toxic Substances Control (DTSC) as the enforcement body for the PFAS related bills. 

On or before January 1, 2029, DTSC shall adopt regulations to implement, interpret, enforce, or make specific this bill and the covered PFAS restrictions. Meanwhile, on or before January 1, 2029, DTSC shall publish on its internet website a list of accepted methods for testing whether a covered product complies with the covered PFAS restrictions and appropriate third-party accreditations for laboratories. 

On or before July 1, 2029, the manufacturer of a covered product shall register and provide to DTSC all of the following information: 

  • The name and a description of each covered product 
  • The applicable registration fee 
  • A statement of compliance certifying that each covered product is in compliance with the applicable covered PFAS restriction and the technical documentation (including analytical test results) requested by DTSC to demonstrate compliance 

On and after July 1, 2030, DTSC shall enforce and ensure compliance with this bill.
