Main content or requirements On 15 February 2024, Germany amended the Chemicals Prohibition Ordinance (ChemVerbotsV). The entry for pentachlorophenol, its salts and compounds was removed on 16 February 2024, while the entry for formaldehyde is to be removed on 7 August 2026. Equivalent or stricter requirements are laid down for those substances in the EU POPs Regulation and in Entries 28 and 77 of Annex XVII to the EU REACH Regulation

On 15 February 2024, Germany published the Ordinance of 13 February 2024 (Verordnung vom 13. Februar 2024) to amend the Chemicals Prohibition Ordinance (ChemVerbotsV). The following two entries in Appendix 1 to the ChemVerbotsV shall be removed. The equivalent or stricter requirements are laid down for those substances in the EU POPs Regulation (EU) 2019/1021 and in Annex XVII to the EU REACH Regulation (EC) No 1907/2006.

  1. Entry 3 (Pentachlorophenol (PCP), its salts and compounds) on 16 February 2024;
  2. Entry 1 (Formaldehyde) on 7 August 2026

Entry 3 (Pentachlorophenol (PCP), its salts and compounds) had set the content limit of 5 mg/kg for products that have been treated with a mixture containing such substances. The requirement can be covered by the current EU POPs Regulation (EU) 2019/1021.

Entry 1 (Formaldehyde) had set a formaldehyde release limit for coated and uncoated wood-based materials (chipboard, blockboard, veneer boards, and fiber boards), as well as a formaldehyde content limit (0.2%) for detergents, cleaning and care products. The former can be covered by the EU REACH Regulation (EC) No 1907/2006 Annex XVII Entry 77 on formaldehyde release (0.062 mg/m3) and the latter can be covered by Entry 28 on substances and mixtures containing CMR substances (0.1%).
