U.S. Congress Proposes Bill to Ban Procurement of Products Containing PFAS
 

In July and November 2023, U.S. congress proposed bill S. 2283 “PFAS-Free Procurement Act of 2023” to prohibit the procurement of certain items containing perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA) and prioritize the procurement of products not containing PFAS. 

Per the proposal, beginning on October 1, 2025, the head of an executive agency, defined under §133 to Title 41 of the United States Code, may not enter into a new contract for the procurement of a covered item that contains perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA). 

The proposed Act also directs that the head of an executive agency shall prioritize the procurement of covered items, where available and practicable, that do not contain harmful perfluoroalkyl or polyfluoroalkyl substances (PFAS). 

The “covered items” includes (A) nonstick cookware and cooking utensils; and (B) furniture, carpets, and rugs treated with stain-resistant coatings.
