On September 20, 2023, the U.S. Consumer Product Safety Commission (CPSC) published a notice to request information on per- and polyfluoroalkyl substances (PFAS) used in consumer products.

PFAS are manufactured chemicals that contain multiple fluorine atoms attached to carbon chains. PFAS have a variety of applications, including in non-stick cookware; water-repellent and stain resistant clothing, carpets and other fabrics; some cosmetics; some firefighting foams; and common home products such as cleaning supplies, waxes, coatings, adhesives, paints, and sealants. But PFAS can move through the environment, and they break down very slowly. They are commonly referred to as “forever chemicals.” Many studies have shown that PFAS may be detrimental to human health, including neurotoxicity, immunotoxicity, and can negatively impact reproduction and development.

CPSC requests information from all stakeholders such as consumers, manufacturers and importers, government agencies, non-governmental organizations, and researchers. CPSC seeks comment on all significant aspects of this issue, including but not limited to the following questions.

1. Use or potential use of PFAS in consumer products PFAS
2. Potential human exposures to PFAS associated with consumer products use, including information about potentially highly exposed population groups
3. Potential adverse human health effects informed by toxicological data

Written comments must be submitted by November 20, 2023. 

This request for information (RFI) does not constitute or propose regulatory action, but rather is intended to inform the Commission and the public. However, CPSC PFAS White Paper recommends regulation as a next step since “additional regulations are necessary to protect human health and the environment, provide consumers with products that are safe for use, and ensure that industry and product manufacturers have clear requirements so that they can appropriately substitute PFAS with safer alternatives that meet performance standards.”
