U.S. Maine Amended PFAS Reporting Requirements on Consumer Products
On June 8, 2023, the U.S. Maine Legislature has passed Bill H.P. 138 - L.D. 217 to amend PFAS reporting requirements on consumer product.
The reporting deadline for PFAS has been extended from January 1, 2023 to January 1, 2025.
The written notification to the Department of Environmental Protection has been updated as below:
- A brief description of the product, including an estimate of the total number of units of the product sold annually in the State or nationally
- The purpose of PFAS used in the product
- The amount of each of the PFAS, identified by its chemical abstracts service registry number or in the absence of this number a description approved by the department, in the product, reported as an exact quantity, or as the amount of total organic fluorine if the amount of each PFAS compound is not known, determined using commercially available analytical methods or based on information provided by a supplier as falling within a range approved for reporting purposes by the department
- The name, address, and the contact of the manufacturer
- Any additional information required by the department
In addition, the requirements do not apply if the employer has 25 or fewer employees.
Meanwhile, the new bill clarifies packaging is exempted; but notes that if packaging is the product of the manufacturer will not be exempted. And used products or product components will also be exempted.
