Oregon Proposed to Permanently Amend Administrative Rules Related to the Toxic Free Kids Act

The Oregon Health Authority (Authority), Public Health Division is proposing to permanently amend administrative rules in chapter 333, division 16 related to the Toxic Free Kids Act. This proposed rulemaking is intended to:

  1. Make the Temporary Administrative Order PH 40-2021 permanent.
  2. Add five* High Priority Chemicals of Concern for Children's Health (HPCCCH) from Washington State Department of Ecology’s Reporting List of Chemicals of High Concern to Children (CHCC)

Once the draft is passed, the proposed changes

  • for the PH 40-2021 to be permanent will apply to biennial notifications due on January 1, 2022 for products sold or offered for sale in Oregon in 2020 and 2021
  • for the additions of five chemicals will be effective January 1, 2022, and will apply to biennial notifications due on January 1, 2024 for products sold or offered for sale in Oregon in 2022 and 2023

* The five HPCCCH are:

  • 84-61-7 Dicyclohexyl phthalate (DCHP)
  • 84-69-5 Diisobutyl phthalate (DIBP)
  • 1241-94-7 Ethylhexyl diphenyl phosphate (EHDPP)
  • 68937-41-7 Isopropylated triphenyl phosphate (IPTPP)
  • 108171-26-2 Chlorinated paraffins
