USA - CPSC Published Final Rule on Safety Standard for Gates and Enclosures (16 CFR 1239)

The U.S. Consumer Product Safety Commission (CPSC) has published Final Rule on the new safety standard for gates and enclosures (16 CFR 1239). The Final Rule shall become effective on 6 July 2021.

Subject: USA - CPSC Published Final Rule on Safety Standard for Gates and Enclosures (16 CFR 1239)

The U.S. Consumer Product Safety Commission (CPSC) has published Final Rule on the new safety standard for gates and enclosures (16 CFR 1239). The Final Rule shall become effective on 6 July 2021.

According to the Final Rule, each gate and enclosure shall comply with all applicable provisions of ASTM F1004-19 Standard Consumer Safety Specification for Expansion Gates and Expandable Enclosures, with some changes including the following:

  • a. Adding Section 6.8 on requirements for visual side-pressure indicators
  • b. Amending Section 7.9.1.2 on the test procedure for horizontal push-out test
  • c. Replacing Section 8.5.3 by Section 8.5.8 on labelling of a warning statement for pressure-mounted gates that provide wall cups or other mounting hardware
  • d. Adding Section 9.5 on instructional literature for pressure-mounted gates with visual side-pressure indicators

ASTM F1004-19 shall apply to the following products intended for young children aged from 6 months to 24 months:

  • a. Expansion gate, which means a barrier intended to be erected in an opening, such as a doorway, to prevent the passage of young children, but which can be removed by older persons who are able to operate the locking mechanism.
  • b. Expandable enclosure, which means a self-supporting barrier intended to completely surround an area or play-space within which a young child may be confined.

Subject: USA - CPSC Proposed Rule on Gates and Enclosures (16 CFR 1239)

The U.S. Consumer Product Safety Commission (CPSC) has proposed a new safety standard for gates and enclosures (16 CFR 1239). According to the proposed rule, each gate and enclosure shall comply with all applicable provisions of ASTM F1004-19 Standard Consumer Safety Specification for Expansion Gates and Expandable Enclosures.

ASTM F1004-19 shall apply to children’s gates and enclosures intended for young children aged from 6 months to 24 months, serving as barriers that are intended to be erected in an opening to prevent the passage of young children.

Children’s gates and enclosure shall include:

  • a) Expansion gate, which means a barrier intended to be erected in an opening, such as a doorway, to prevent the passage of young children, but which can be removed by older persons who are able to operate the locking mechanism.
  • b) Expandable enclosure, which means a self-supporting barrier intended to completely surround an area or play-space within which a young child may be confined.
