1、 < Decision of the General Administration of Market Supervision on Amending the Four Regulations Including the Implementation Rules for the Registration and Administration Regulations of Enterprise Legal Persons of the People’s Republic of China > (2019-08-08)

The Decision of the General Administration of Market Supervision on Amending the Four Regulations Including the Implementation Rules for the Registration and Administration Regulations of Enterprise Legal Persons of the People’s Republic of China has been gazetted by the General Administration of Market Supervision on 8th August 2019, and has come into force on the same day. Four regulations have been revised including the Implementation Rules for the Registration and Administration Regulations of Enterprise Legal Persons of the People’s Republic of China, the Registration and Management Regulations on Foreign Investment Partnership Enterprise, the Measures on Registration and Management of Individual Proprietorship Enterprises and the Measures on Registration and Management of Individual Industrial and Commercial Households.

The main revisions are as follows:

  • Enterprises no longer need to separately go through the approval and registration of enterprise groups and apply for the “Enterprise Group Registration Certificate”;
  • The establishment of branch offices, and the establishment, change and cancellation of foreign-invested partnership enterprises will not be filed separately;
  • If the business license is lost or damaged, it is no longer necessary to publish the invalidation statement in the newspapers and periodicals designated by the enterprise registration authority. Instead, it can be declared invalid in the “Business License Invalidation Statement” column of the National Enterprise Credit Information Publicity System, without any cost;
  • The management organization is changed from “Industrial and Commercial” to “Market Supervision”.

1. < Notice on the Establishment of a Regular Notification System for the List of the Responsible Subject for the Substandard Prevention and Control Measures of Occupational Diseases > (2019-08-19)

The Notice on the Establishment of a Regular Notification System for the List of the Responsible Subject for the Substandard Prevention and Control Measures of Occupational Diseases was jointly formulated and promulgate by the Guangdong Provincial Hygiene Health Commission and Guangdong Banking and Insurance Supervision Bureau and has come into force on 19th August 2019. The relevant contents as follows:

  1. Employers who failed to complete the requirements for rectification of occupational disease hazards within the prescribed time limit shall be punished or suspended according to laws, and shall be included in the name list of underqualified occupational disease prevention and control managements (hereinafter referred to as the “list”).
  2. The employers who were included in the list shall take the occupational disease prevention and control measures, the employer or technical institution shall provide written instructions to the original information collection of hygiene and health department after effectively control the risk of occupational disease hazards.
  3. In accordance with the relevant provisions of Notice of the China Banking Regulatory Commission on Printing and Distributing Green Credit Guidelines, the environmental and social risks of the responsible subjects for the substandard prevention and control measures of occupational diseases determined by the hygiene and health departments shell be dynamically evaluated and classified, the relevant results should be regarded as an important basis for their ratings and credit access, management and withdrawal.

2、< Management Measures on Emergency Plan of Production Safety Accident > (2019-09-01)

The Management Measures on Emergency Plan of Production Safety Accident (hereinafter referred to as Measures) was approved by 20th meeting of the Ministry of Emergency Management of PRC on 24th June 2019, and has come into force on 1st September 2019. The main revised content are as follows:

  1. When the production and business operation unit applies for the filling of emergency plan, as stipulated in article 27 of the measure, it shall submit the “electronic document of emergency plan”, amended from “text and electronic document of emergency plan”.
  2. Article 26 of the Measures was amended accordingly to stipulate the production, operation, storage and transportation units of dangerous articles such as inflammable and explosive materials and dangerous chemicals, and related key units such as mining, metal smelting, urban rail transit operations and construction units, shall apply for emergency plan register from relevant departments according to the principle of graded territoriality.
  3. The Measures define that the production and business operation units don’t conduct emergency plan register would be punished according to the requirements of the “Emergency Regulations of Production Safety Accident”.

< Technical Specification for Application and Issuance of Pollutant Permit - Electronics industry > HJ1031-2019 (2019-07-23)

The Technical Specification for Application and Issuance of Pollutant Permit - Electronics industry (hereinafter referred to as Specification) has been gazetted by the Ministry of Ecology and Environment on 23rd July 2019 and came into force on the same day. The Specification defines technical requirements on management of pollutant discharging permit, the main contents are as follows:

  • The Specification is applicable to permission management of air pollutants and wastewater pollutants discharged by electronics industry pollutant discharging units, also applicable to pollutant discharging units in electronics industry involving electroplating process.
  • The Specification is applicable to guide the pollutant discharging units in electronics industry to fill in relevant application information on the online platform for pollutant discharge permit management and to guide the authority to determine the requirements of permission of the Pollutant Discharging Permit for the pollutant discharging unit in electronics industry.
  • The Specification provides pollutant discharging unit in electronics industry with the requirements on declaration of general information, determination of permissible emission limits, the method on the calculation of actual emission and judgment of compliance, the environmental management requirements on self-monitoring, ledger and the executive report on pollutant discharging permit, and feasible technical requirements on pollution prevention and control for pollutant discharge unit in electronics industry.
  • The production facilities and pollutant outlets of pollutant discharge unit in electronics industry which follows the Boiler air pollutant emission standard (GB13271) shall follow the Technical Specification for Application and Issuance of Pollutant Permit - Boiler (HJ 953).
  • Other facilities discharging pollutant and pollutant outlets in pollutant discharge unit which discharging industrial wastewater, air pollutant or toxic and hazardous Pollutants specified by state in electronics industry but not specified in the Specification shall follow the Technical Specification for Application and Issuance of Pollutant Permit - General Programme (HJ 942).
