Labour

1. < Opinions on Promoting the Establishment of Harmonious Labor Relations in the New Era > (2023-01-03)

The Ministry of Human Resources and Social Security, the National Federation of Trade Unions, the China Association of Enterprises / China Entrepreneur Association and the National Federation of Industry and Commerce jointly issued the Opinions on Promoting the Establishment of Harmonious Labor Relations in the New Era (hereinafter referred to as the Opinions) on 3rd January 2023. The Opinions put forward that all kinds of enterprises and enterprise gathering areas should carry out harmonious labor relations building activities by the end of 2027, so as to achieve a richer content of creation, more standardized creation standards, more scientific creation evaluation, and more perfect creation incentive measures.

Among the key contents of enterprise establishing activities, the Opinions put forward that the labor contract and collective contract system should be fully implemented, the democratic management of enterprises should be strengthened, and the basic rights and interests of employees such as labor remuneration, rest and vacation, labor safety and health, social insurance, vocational skill training should be guaranteed according to law; establish a collective negotiation and normal growth mechanism for workers' wages, strengthen labor protection and improve working conditions; establish an labor dispute mediation committee, strengthen labor dispute prevention, and promote labor dispute negotiation and reconciliation.

Health and Safety

1. < General Specification for Fire Protection Facilities > (2023-03-01)

The General Specification for Fire Protection Facilities (hereinafter referred to as the Specification) was promulgated by the Ministry of Housing and Urban-Rural Development of PRC on 15th July 2022 and will come into force as on 1st March 2023. The main contents and characteristic of the Specification are as follows:

  1. The Specification is applicable to the design, construction, acceptance, use and maintenance of fire-fighting facilities install in new, expanded and reconstructed construction projects and fire-fighting facilities reconstruction of existing buildings.
  2. The Specification mainly stipulates the design, construction, acceptance, use and function of maintenance,  performance requirements and technical measures for fire water supply and hydrant system, automatic sprinkler system, foam fire extinguishing system, water spray fire extinguishing system, water mist fire extinguishing system, fixed fire cannon , automatic tracking and positioning jet fire extinguishing system, gas fire extinguishing system, dry powder fire extinguishing system, fire extinguisher, smoke control and smoke exhaust system, and automatic fire alarm system.
  3. The Specification highlights the nature of technical regulations, determines the regulatory bottom line requirements and key technical measures for fire protection facilities, and embodies the principle of ensuring personal and property safety. The "technical regulations" system composed of this Specification and the technical provisions in laws, administrative regulations and departmental rules will effectively play the function of fire protection facilities, and scientifically and rationally standardize the design, construction, acceptance, use and maintenance of fire protection facilities.

2. < Notice of the General Office of the National Health Commission on Further Strengthening the Occupational Health Training of Employers > (2022-12-13)

The Notice of the General Office of the National Health Commission on Further Strengthening the Occupational Health Training of Employers (hereinafter referred to as the Notice) was promulgated by the General Office of National Health Commission on 13th December 2022, and has come into force as of the date of promulgation. 

The Notice puts forward specific requirements for strengthening the occupational health training of employers from the following five aspects:

  1. Fully recognize the importance of occupational health training. The health administrative departments at all levels shall attach great importance to the occupational health training of employers and further guide employers to carry out occupational health training according to laws and regulations.
  2. Urge the employer to strictly implement the main responsibility of occupational health training. The health administrative departments at all levels shall urge employers to establish and improve the management system of occupational health training and effectively implement the main responsibility of occupational health training.
  3. Strengthen the communication and information construction of occupational health training of employers. The health administrative departments at all levels shall timely investigate and summarize the work of occupational health training of employers and promote the advanced experience and effective practices of occupational health training.
  4. Strengthen the guidance of occupational health training of employers. Health administrative departments at all levels shall guide employers in different industries to carry out occupational health training according to the characteristics of industries and posts.
  5. Strengthen the supervision and management of occupational health training quality of employers. The health administrative departments at all levels shall check the effect of occupational health training in various forms and urge employers to continuously improve the quality of occupational health training.

Environment

1. < Administration Measures for the List of Key Entities under Environmental Regulation > (2023-01-01)

The Administration Measures for the List of Key Entities under Environmental Regulation (hereinafter referred to as the Measures) has been gazetted by the Ministry of Ecology and Environment on 28th November 2022 and has come into force on 1st January 2023, the original Provisions on the administration of the list of key pollutant discharge units (Trial) has been abolished on the same date. The main contents of the Measures are as follows:

1. The Measures specified management and control scope of key entities

  • Key entities under environmental regulation includes key entities discharging pollutants to water environment, key pollutant discharging entities for under groundwater pollution prevention and control, key entities discharging pollutants for atmospheric environment, key entities producing noise pollution, entities under priority regulation of soil pollution, and entities under priority management and control of environmental risks as determined in accordance with the law. The same enterprise or public institution may belong to different types of key entities under environmental regulation at the same time.

2. The Measures specified principle to determine key entities

  • Screening principle: The key entities shall be determined according to the environmental capacity of the administrative region, the requirements of the total emission control target of key pollutants, the types, quantities and concentrations of pollutants discharged by the pollutant discharging unit, the noise emission status and the requirements for improving the quality of the acoustic environment, etc.
  • Principle of regulatory demand: According to the needs of regional environmental regulation, district-divided cities may include enterprises that cause pollution into key units of environmental regulation.
  • The relationship between the key units of environmental supervision and control and the key units in the classified management of pollutant discharge permits has been clarified, and the ecological environment administrative departments of districted cities shall timely adjust the list of key pollutant discharge units in accordance with the screening conditions stipulated in the Measures.
  • The Measures emphasized the importance of putting people first and included enterprises with strong public complaints about noise pollution into the list.

3. The Measures define the environmental protection obligations of enterprises included in the list

  • Key pollutant discharging entities of under groundwater pollution prevention and control and entities under priority management and control of environmental risks was added in the list scope based on the original Provisions on the administration of the list of key pollutant discharge units (Trial).

4. The Measures specified the environmental obligations of the listed entities

  • Perform the legal obligations of self-monitoring in accordance with the law. It mainly refers to the installation of online monitoring facilities, operating in line with ecological and environmental protection departments, keeping monitoring facilities in good operation, and properly keeping original monitoring records.
  • Fulfill the legal obligation of information disclosure in accordance with the law. The listed entities must, in accordance with the requirements for the disclosure of ecological and environmental protection information, disclose information on pollution prevention and control of enterprises in a specified manner and at a specified frequency, and accept social supervision.
  • Take proactive measures to prevent and control environmental pollution. In addition to complying with the requirements of environmental assessment management of construction projects and emission permit management, the listed entities shall also take proactive measures to reduce emissions, such as cleaner production, in-depth management and becoming benchmarking enterprises in the industry, in accordance with the requirements of the battle against pollution.
  • Proactively guard against environmental risks. In accordance with the principle of putting prevention first, the listed entities shall regularly update and improve their emergency plans for pollution accidents and carry out emergency training and drills.
  • Actively cooperate with supervision and management. Dynamically improve the archives of pollution prevention and control of enterprises, actively cooperate when the ecological environment department conducts on-site law enforcement, and provide necessary facilities and conditions for on-site monitoring.
