U.S. Colorado Approved Restriction of the Use of PFAS on Cookware, Juvenile Products, Cosmetic and Other Certain Products

On June 3, 2022, U.S. Colorado Governor has signed the bill HB 22-1345, Perfluoroalkyl and Polyfluoroalkyl Chemicals Consumer Protection Act, which restrict the use of Perfluoroalkyl and Polyfluoroalkyl Chemicals (PFAS).

The following products containing intentionally added PFAS chemicals shall not be sold, distributed or used in Colorado after the relevant effective date:

Fabric treatments
Plant-based food packaging
Juvenile products
Oil and gas products
Cosmetic 1 January 2025
Indoor textile furnishings
Indoor upholstered furniture
Outdoor textile furnishings 1 January 2027
Outdoor upholstered furniture

Besides, on and after 1 January 2024, cookware containing intentionally added PFAS chemicals in the handle of the product or in any product surface that comes into contact with food, foodstuffs, or beverages shall list the presence of PFAS chemicals on the product label, and shall include on the product label a statement, in both English and Spanish, that reads: 

“For more information about PFAS chemicals in this product, visit” followed by both of the following: 

(i)An internet website address for a web page that provides information about why the PFAS chemicals are intentionally added; and

(ii)A quick response (QR) code or other machine-readable code, consisting of an array of squares, used for storing an internet website for a web page that provides information about why the PFAS chemicals are intentionally added.

The labeling shall be visible and legible to the consumer, including on the product listing for online sales.

The above labelling requirement can be exempted only if:

1.The surface area of the cookware cannot fit a product label of at least 2 square inches; and

2.The cookware does not have an exterior container or wrapper on which a product label can appear or be affixed, or a tag or other attachment with information about the product attached to the cookware.

In addition, on and after 1 January 2024, a manufacturer shall not claim that the cookware is free of any PFAS chemical unless no individual PFAS chemical is intentionally added.

Meanwhile, on and after 1 January 2024, the Class B firefighting foam containing intentionally added PFAS chemicals is not allowed to be released. The law also requires fully containing the firefighting foam during its use, safe storage and reporting certain information within 24 hours if there is a release.   

Note: 

1."Carpet or rug" means a fabric marketed or intended for use as a floor covering in households or businesses.

2.“Fabric treatment” means a product applied to fabric to give the fabric one or more characteristics, including stain resistance or water resistance.

3."Food package" means a package or packaging component used in direct contact with food and that is composed, in substantial part, of paper, paperboard, or other materials originally derived from plant fibers.

4.“Juvenile product” means a product designed for use by infants or children under 12 years old, which includes:

  • bassinets and other bedside sleepers;
  • booster seats, car seats, and other child restraint systems;
  • changing pads;
  • co-sleepers;
  • crib or toddler mattresses;
  • floor play mats;
  • highchairs and highchair pads;
  • infant bouncers;
  • infant carriers;
  • infant or toddler foam pillows;
  • infant seats;
  • infant sleep positioners;
  • infant swings;
  • infant travel beds;
  • infant walkers;
  • nap cots;
  • nursing pads and pillows;
  • play mats;
  • playpens;
  • play yards;
  • polyurethane foam mats, pads, or pillows;
  • portable foam nap mats;
  • portable infant sleepers and hook-on chairs;
  • soft-sided portable cribs; and
  • strollers.

“Juvenile product” does not include: 

  • Electronic products, including personal computers and any associated equipment, audio and video equipment, calculator, wireless phone, game console, handheld device incorporating a video screen, and any associated peripheral device such as a mouse, keyboard, power supply unit, or power cord
  • An internal component of juvenile products that would not come into direct contact with a child’s skin or mouth during reasonably foreseeable use and abuse of the product
  • Adult mattress
